|| The Fundamental Philosophy of the Rule of LawThe foundation of a civilized, democratic, and humane state is the Rule of Law. One of its most fundamental principles is that no individual shall be regarded as guilty unless and until a competent court of law establishes guilt through a fair and lawful judicial process.While it is the responsibility of the State to combat crime and ensure public safety, it is equally its duty to protect innocent individuals from unjust harassment, arbitrary detention, and the abuse of state power.The Constitution of Bangladesh guarantees every citizen the rights to life, personal liberty, and equal protection of the law. Likewise, international human rights instruments recognize every accused person’s right to a fair trial, due process, and the opportunity to defend themselves before an impartial tribunal.Therefore, regardless of how controversial a person may be or how serious the allegations against them appear, treating them as a criminal before a final judicial verdict is contrary to the very essence of justice and the Rule of Law.A Criminal Charge Is Not the Same as a Criminal ConvictionA widespread misconception in Bangladesh is that once a criminal case is filed against someone, they must already be guilty. This assumption is fundamentally flawed.A criminal case merely marks the beginning of an allegation. Whether the allegation is true must be determined through investigation, collection of evidence, examination and cross-examination of witnesses, and ultimately by a court of competent jurisdiction.In many instances, individuals are completely acquitted after lengthy judicial proceedings. Yet by that time, they may have already lost their careers, social standing, financial stability, family relationships, and mental well-being. Such irreparable harm often cannot be fully remedied, even after acquittal.Pre-Trial Detention Should Not Become Punishment Before ConvictionBangladesh’s prisons contain a significant number of pre-trial detainees who have not yet been convicted of any crime.In practice, many individuals spend five, seven, or even ten years in custody awaiting the conclusion of their trials. If they are eventually acquitted, such prolonged detention raises serious concerns regarding justice, fairness, and respect for fundamental human rights.Personal liberty is one of the most basic human rights. Detaining individuals for years without a final conviction can effectively become a form of punishment before guilt has been established.There are, of course, exceptional circumstances in which pre-trial detention may be justified—for example, where it is necessary to protect the integrity of an investigation, safeguard witnesses, prevent destruction of evidence, or reduce the risk of absconding. However, such detention should remain the exception rather than the rule. Exceptional measures should not become ordinary practice.False Cases: A Silent Challenge to the Justice SystemIt is frequently alleged that, in some instances, criminal cases in Bangladesh are filed out of personal revenge, political rivalry, business disputes, land conflicts, or other malicious motives.At the same time, it is equally important to recognize that the majority of criminal cases are filed on the basis of genuine complaints. Ensuring justice for genuine victims remains a fundamental obligation of the State. Equally, protecting innocent citizens from malicious or vexatious litigation is also an essential responsibility.It cannot be denied that certain incidents occurring within the justice system are not only deeply unfortunate but also inconsistent with the principles of fairness and justice.When criminal proceedings become instruments of harassment rather than mechanisms for discovering the truth, the consequences extend beyond the individual victim. Public confidence in the justice system itself is undermined. A just and humane society cannot flourish without restoring trust in the integrity of judicial institutions.Preliminary Verification Before Registering Certain ComplaintsAn important area for judicial reform concerns strengthening preliminary scrutiny, wherever permitted by law, before certain categories of complaints proceed through the criminal justice process.The objectives of such preliminary verification may include:* Determining whether the complaint possesses a minimum factual basis;* Identifying complaints filed solely for malicious or abusive purposes;* Protecting innocent individuals from unnecessary arrest and harassment;* Ensuring that genuine victims receive prompt and effective investigation.However, any preliminary scrutiny mechanism must be carefully designed so that it does not create unnecessary barriers for genuine victims seeking justice.Deliberately False Cases Should Carry Legal ConsequencesPreventing abuse of the judicial system requires effective legal consequences against those who intentionally misuse it.Where it is established through due legal process that:* allegations were knowingly false;* fabricated evidence was intentionally created; or* legal proceedings were initiated solely for personal vengeance or harassment,appropriate legal action should be taken against those responsible.At the same time, an important distinction must be maintained. The dismissal of a case or the acquittal of an accused person does not automatically prove that the complainant acted maliciously. Deliberate falsehood must itself be independently established according to law.Bail Should Be the General RuleA well-recognized principle of modern criminal justice is:“Bail, not Jail.”Where there is no substantial risk to public safety, no likelihood of interference with the investigation, no realistic possibility of tampering with evidence, and no significant risk of flight, granting bail should generally be the norm, while pre-trial detention should remain an exceptional measure.Such an approach protects individual liberty while simultaneously reducing prison overcrowding.Timely Justice Is a Fundamental Human RightJustice delayed is often justice denied.Excessive delays in investigation and trial undermine public confidence in the judicial process and may themselves constitute a form of injustice.Meaningful reforms should therefore focus on:* expediting investigations;* timely submission of charge sheets;* appointing sufficient judges;* utilizing modern judicial technology;* and accelerating the recording of evidence and completion of trials.Social Media Must Not Become a Court of LawIn today’s digital era, individuals are often declared guilty—or innocent—on social media within hours of an allegation being made.This is a dangerous trend.Justice must be administered by courts of law, not by Facebook, YouTube, television talk shows, or online public opinion. While public discourse is valuable in a democratic society, it can never replace due judicial process.Judicial Reform Is Essential to Restore Public ConfidenceTo strengthen Bangladesh’s justice system, serious consideration should be given to the following reforms:* Enhancing professionalism in case registration and criminal investigations;* Preventing malicious and vexatious litigation;* Reducing unnecessary arrests;* Applying bail principles more consistently and reasonably;* Ensuring the timely disposal of pending cases;* Taking appropriate legal action against deliberately false complaints;* Further strengthening the independence, impartiality, and integrity of the judiciary.ConclusionJustice constitutes one of the greatest strengths of any democratic state.The strength of a legal system lies not merely in punishing the guilty, but equally in protecting the innocent.A truly just society ensures that genuine offenders do not escape accountability while innocent individuals are protected from false accusations, arbitrary arrests, and prolonged pre-trial detention. Maintaining this delicate balance represents the true purpose of the Rule of Law.The filing of a criminal case signifies only the commencement of an allegation; it is not proof of guilt. Treating an accused person as a criminal before the conclusion of a fair trial, or subjecting them to unnecessary prolonged detention, weakens the very foundations of justice. Likewise, filing deliberately false cases to harass others is equally incompatible with the Rule of Law.Bangladesh needs a justice system in which genuine offenders are held accountable, innocent citizens receive meaningful legal protection, malicious prosecutions are effectively discouraged, and public confidence in the administration of justice is firmly restored.Md.
